A new scandal has rocked the art world, the likes of which have not been seen since the "early Vermeer" scandal of the 1940s. Sotheby’s was recently forced to take back an £8.4 million ‘Frans Hals,’ because it was revealed to be a fake. The paintings in question are Old Masters, said to be by Frans Hals, Lucas Cranach, and others. Few major art figures are willing to speak openly because the scandal is a matter of such embarrassment, but one well-known dealer has described the individual behind the forgeries as the “Moriarty of fakers” because they are so brilliantly constructed.

With a trial looming, the Knoedler Gallery, its former director Ann Freedman, and Knoedler’s owner 8-31 Holdings have reached a settlement with the New York collector John Howard. Howard had bought a fake work by Willem de Kooning from the gallery for $4m. The lawsuit arose from Knoedler’s selling some $60m of fake Abstract Expressionist art in a scandal that sent shivers through the art world when it broke in late 2011.

In a forgery scandal that shook the art world, the now-shuttered Knoedler Gallery and its former director Ann Freedman will have to go to trial in two cases involving the sale of fake Abstract Expressionist paintings, Manhattan’s federal court ruled on Wednesday, 30 September.  

In his three-page order, Judge Gardephe denied the gallery’s and Freedman’s motions for summary judgment in the lawsuits brought by the New York collector John Howard and Sotheby’s chairman Domenico De Sole and his wife, Eleanore.

The Toledo Museum of Art announced that it will return a nearly 1,000-year-old bronze sculpture of the Hindu god Ganesha to the Government of India.

The Ganesha was purchased in 2006 from art dealer Subhash Kapoor, who is currently awaiting trial in India on charges of illegal exportation, criminal conspiracy and forgery.

Research conducted by the Museum, with the assistance and cooperation of the Indian Consulate General, Dnyaneshwar M. Mulay, and the Ambassador of India, Dr. S. Jaishankar, and their respective representatives, led Museum Director Brian Kennedy to recommend the return to the Museum’s Art Committee. That committee voted on Aug. 21 to deaccession the Ganesha from the collection and facilitate its return.

In what has been termed a “document dump”, previously undisclosed information and inflammatory allegations in two of the Knoedler gallery art-forgery lawsuits are now public for the first time. Last Wednesday, Knoedler, its former director Ann Freedman, the head of a related holding company Michael Hammer, and a former employee Jaime Andrade filed motions seeking to dismiss the lawsuits. The next day, the collectors Eleanore and Domenico De Sole and John Howard struck back, arguing that their cases must go to trial and accusing Freedman of perjury “on multiple occasions, including before this court”, a charge she vigorously denies.

More than 500 pages of legal arguments and thousands of pages of exhibits are now before Manhattan’s federal court.

In his first television interview, the elderly artist whose look-alike paintings in the styles of Abstract Expressionists including Mark Rothko and Jackson Pollock fooled experts and sent shock waves through the art world claims he was ”shocked” to learn that his works were sold as newly discovered masterpieces to wealthy collectors for tens of millions of dollars.

“When I made these paintings, I had no idea they would represent them as the real thing to sell,” said Pei Shen Qian in an interview to be broadcast Tuesday on “World News With Diane Sawyer” and “Nightline” as part of an ABC News investigation of the fake art industry and the Long Island fraud ring that flooded the market with over $80 million in forged work.

A painting, which Spanish tax authorities claimed was Van Gogh’s Cypress, Sky and Country (1889), is in fact a terrible fake according to Alfred Weidinger, vice director of Vienna’s Belvedere. The painting was discovered during a raid of safe deposit boxes in Madrid. Speaking to Austrian daily, Die Presse, Weidinger says, “It is one of the worst fakes or, better yet, copies, that I have ever seen. An amateur must have done it based on a calendar shot of the original.”

According to Weidinger, that original from Van Gogh’s Cypress series was indeed painted in 1889 but hangs in New York’s Metropolitan Museum. He says that he spoke with an expert from the Van Gogh museum in Amsterdam who was similarly shocked at just how bad the painting appears to be.

Three men were charged on Monday, April 21, in connection with a forgery scam led by the Long Island-based art dealer, Glafira Rosales. During the fifteen-year scheme, Rosales and her accomplices sold counterfeit works that mimicked the styles of modern masters, including Jackson Pollock, Willem de Kooning, and Mark Rothko, through well-known galleries such as the now-shuttered Knoedler & Company gallery in New York. Rosales and her camp swindled unsuspecting customers out of more than $33 million. 

Among the trio was the Queens-based painter Pei Shen Qian, who allegedly made the forgeries and is believed to have fled to China. Qian, who has been charged with wire fraud conspiracy, wire fraud, and making false statements, faces up to 45 years in prison if he is convicted. Brothers Jesus Angel Bergantinos Diaz and Jose Carlos Bergantinos Diaz were arrested last week in Spain. Jesus faces up to 80 years in jail and Jose faces a maximum sentence of 100 years behind bars. Rosales, who already pleaded guilty, is awaiting sentencing. She faces up to 99 years in prison.

Manhattan US Attorney, Preet Bharara, said, "Today's charges paint a picture of perpetual lies and greed...With today's Indictment, the defendants must now answer for their alleged roles as modern masters of forgery and deceit.”

Las Vegas billionaire Frank Fertitta III is suing a respected Swiss curator accused of standing behind the authenticity of a Mark Rothko painting that turned out to be a fake. Feritta acquired “Untitled (Orange, Red and Blue)” from New York’s disgraced Knoedler gallery in 2008. He paid $7.2 million for the canvas.

Oliver Wick, a Swiss Rotko expert and specialist in American paintings, received $300,000 for the sale. According to court documents, Wick “was aware of substantial evidence that the painting was a forgery” and “conducted no independent research into the authenticity of this fake Rotko.” The painting had been exhibited at the Fondation Beyeler museum in Basel, Switzerland, where Wick was a curator.

Knoedler, which closed in 2011, has been accused by multiple clients of selling forged paintings. The forgeries, which were presented as authentic works by Rothko, Jackson Pollock, Robert Motherwell, Franz Kline, and Willem de Kooning, had been painted by a Queens-based Chinese artist and sold to Knoedler by Glafira Rosales, a Long Island art dealer. Rosales pleaded guilty to nine charges, including wire fraud, tax fraud, and money laundering, last September. During her 15-year scheme, Rosales swindled unsuspecting customers out of over $80 million.
